Fairness In Financial Support
Child support ensures the child’s needs are met. Spousal support provides temporary or ongoing assistance to a disadvantaged spouse. If support is too low, the recipients suffer. If it’s too high, it creates hardships for the paying party.
Lawyers With Heart aims to strike that balance. We work to ensure fairness and accuracy in the determination of child support or alimony and resolve disputes without resorting to the courts.
The Pennsylvania child support guidelines are fairly straightforward. The formula is based on the incomes of each parent and the number of children. Support can be artificially low when a parent is self-employed, paid in cash or underemployed. We make sure the court has accurate financial data. At the other extreme, if one parent’s income exceeds the top of the guidelines, we can negotiate the amount of child support.
Our lawyers can address temporary orders for child support, paternity actions for child support, and contempt of court for failure to pay support. We also handle modification of child support (up or down) for a significant change in circumstances such as job loss or promotion.
Spousal support or alimony is a payment by one spouse to help cover the other spouse’s basic needs or alleviate an unequal standard of living. In divorce proceedings, alimony is based on need and ability to pay. Our lawyers handle:
- Spousal support payments are regular periodic payments from one spouse to the other before a divorce complaint has been filed
- Alimony pendente lite payments are regular periodic payments from one spouse to the other once a divorce complaint has been filed to help level the playing field when there are differences in incomes
- Alimony payments are regular payments based on circumstances and need for a set period of time after the divorce is final
